RE: The tariff classification of cotton/linen fabric from China

Dear Mr. Harris:

In your letter dated October 17, 2008, on behalf of your client, Global Textile Alliance, you requested a classification ruling.

The submitted sample is identified as style “Autumn”. Autumn is woven fabric composed unbleached and bleached yarns. The fabric is composed of 70% cotton and 30% linen. It is characterized by having been woven with a plain weave except that each group of two warp ends is woven as one (taped warp). This product contains 13.4 single yarns per centimeter in the warp and 12.6 single yarns per centimeter in the filling. Weighing 350 g/m2, this item will be imported in 140 centimeter widths.

The applicable subheading for Autumn will be 5212.22.6040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other woven fabrics of cotton, weighing more than 200 g/m2, bleached, other, duck. The duty rate will be 7.8 percent.

Autumn falls within textile category 219. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
